Mandurah Boat Tours Pty Ltd is the operator of The Pirate Ship vessel, called “The Pirate Ship Mandurah”.

Scam Alert

We have been targeted by ticket scams run through WeChat and social media, paid for with stolen credit cards. Where a booking looks fraudulent, we may require the cardholder to present the card used for the booking before boarding.

We do not sell tickets on WeChat.

General Terms

Liability

Pirate Ship Mandurah is operated by Mandurah Boat Tours Pty Ltd, ABN 63 633 755 405.

Cruising is an outdoor activity on the water and carries risks that cannot be removed entirely, including the movement of the vessel, wet or uneven surfaces, the step between the jetty and the deck, the steps down to the seating, and changes in weather. By boarding, you accept those ordinary risks.

To the extent the law allows, and except where caused or contributed to by the negligence of Mandurah Boat Tours Pty Ltd, our crew or our contractors, we are not liable for death, personal injury, or loss of or damage to property occurring while boarding, while aboard, or while disembarking.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law which cannot lawfully be excluded. Where the law permits us to limit our liability for a service, our liability is limited to resupplying the cruise or paying the cost of having it resupplied.

The Master of the vessel reserves the right to refuse entry of a passenger onto the vessel and to require a passenger to disembark the vessel in the Master’s sole discretion. The passenger acknowledges that the Master of the vessel has the sole and absolute discretion to vary the scheduled route or destination of the cruise if for any reason the Master of the vessel considers it necessary for the safety and welfare of the vessel, its passengers and crew.

We reserve the right to refuse boarding or terminate a cruise if passengers are intoxicated, bring adult entertainment or anything else inappropriate at our sole discretion for The Pirate Ship.

If the cruise is cancelled for any reason by us, including unfavourable weather conditions, mechanical issues or not enough passengers then we will reschedule your booking for a future time if seats are available or offer you a full refund. We reserve the right to make slight alterations to the departure schedule as required to accommodate your trip.

Pricing Policy

All prices are in Australian Dollars (AUD) and include GST. Pirate Ship Mandurah reserves the right to alter the prices at any time.

Nothing in these terms limits your rights under the Australian Consumer Law. Our consumer guarantees cannot be excluded, and the policies here apply in addition to those rights, not instead of them.

Payment and Cancellation Policy

All cancellation requests must be in writing to office@pirateshipmandurah.com.au. Calling, leaving a voicemail or speaking to the team in person is not an acceptable form of cancellation.

Our policies allow changes, but also reflect that we may lose the opportunity to resell seats, or incur costs, when short notice is given. The following applies to The Pirate Cruise, the 90 Minute Scenic Cruise, the Sundowner cruise, Crab Fest cruises and Halloween cruises. Christmas Lights, New Year's Eve and private hire have their own terms, set out below.

  • 7 days' notice or more: a full refund, less card and booking fees.
  • Less than 7 days but at least 24 hours' notice: a 50% refund, a credit for the full value of your tickets valid 12 months, or a reschedule to another date, subject to availability.
  • Less than 24 hours' notice: no refund and no credit. We may offer a reschedule at our discretion, if there is availability.
  • No-show, or arriving too late to board: tickets are forfeited.

These timeframes are counted against the departure date you originally booked, not a date you have moved to. Rescheduling does not restart them.

Private Hires

Private bookings are subject to a non-refundable deposit to be secured. Discounts, specials, promotions and third party offers cannot be applied to existing bookings. Rescheduling (excluding Christmas Lights) can only be done with a minimum of 3 weeks notice. Cancellation will forfeit the deposit.

Christmas Lights cruises 1.5 hour Sunset and Christmas lights cruise and New years eve cruise

Due to the limited availability of these speciality cruises, there are no refunds for cancellations to our Christmas Lights or New Year's Eve cruises. If at least 14 days' notice is given we will offer a voucher for a day cruise to the value of your tickets, valid for one year. We may allow rescheduling at our discretion if availability allows. Rescheduling is not possible once a cruise is 80% sold.

To cancel Christmas Lights tickets, please use our Christmas Lights cancellation form. It asks for everything we need to action the request, and the date we receive it is what decides whether a voucher is offered.

Christmas Lights Private Hire

As above, and in addition: a Christmas Lights private hire cannot be changed or refunded once booked. From that point the date is held for you and we lose the ability to sell those seats, or that date, to anyone else.

Cancellation Fees

Where a refund is due on a booking paid by card, the card and online booking fees are not refunded. Bookings made through a third party booking agency may be subject to that agency's own cancellation terms and fees.

All requests to cancel, change or reschedule any of our cruises must be put in writing and emailed through.

Dress Code

Please wear appropriate footwear, high heels are not suitable for The Pirate Ship Mandurah or any of our departure jetties. It’s your responsibility to dress appropriately for trips on the water, during summer you will need a hat, sunglasses and sunscreen, during winter and night tours throughout the year you will need a warm jacket.

Food and Drink

BYO food is welcome. Alcohol is BYO at one drink per person per 30 minutes aboard, rounded up, so two drinks on a 45 minute cruise. Soft drinks and water are available to buy on board. We are not licensed and there is no bar. Please do not bring large eskies however a small cooler bag is acceptable.

Missing Your Cruise

Boarding opens 15 minutes before your scheduled departure time and closes 5 minutes before it. Please plan to arrive at least 15 minutes early, 20 minutes for Christmas Lights cruises, and allow time for traffic, parking and the walk to the jetty. If you arrive after boarding has closed we may not be able to take you, because we cannot hold a departure or keep the other passengers waiting. Tickets are forfeited if you miss your cruise, and rescheduling is at our discretion and subject to availability.

During the Trip

You are welcome to move about the vessel during the cruise when it is safe to do so, and the crew will tell you when it isn't. Please stay in your seat while we are coming alongside a jetty, and while anyone is boarding or stepping off. Follow the crew's directions at any time. Never put your arms or legs over the railings or through the gaps in the side of the vessel. Never sit on the railings.

Our crew may take photos during the cruise and will take photographs which may be used in marketing material produced by Pirate Ship Mandurah. If you do not wish to be included in our photographs, please advise the photographer at the time.

Children and Supervision

Everyone under 18 must be accompanied by a responsible adult, who stays responsible for them for the whole visit: boarding, the cruise itself, and stepping back onto the jetty.

  • One adult may supervise a maximum of five children.
  • The accompanying adult takes full responsibility for the actions of the children with them, including anything covered by the cleaning and damage sections below.
  • Our crew are there to run the cruise and to keep everyone safe, not to supervise children on your behalf.

Cleaning

If you make an unreasonable mess on the vessel we reserve the right to charge you a minimum of a $150 cleaning fee.

Damage

You will be held liable for any damage caused to the vessel if your actions are not considered fair use or general wear and tear.

These terms are governed by the laws of Western Australia.
